ToS And AUP

Terms of Service


These Term of Service (“ToS” or “Terms”) govern the use of the website Atlir.org, and the virtual private network (“AtlirVPN” or “VPN”), which are owned and operated by Atlir.org (“Atlir”, “we”, “our” or “us”). You (“Client” or “End User”) agree and acknowledge that these terms form a binding legal contract between you and Atlir.


Acceptance


By using, viewing, or accessing any of the services or content provided by Atlir, the client agrees to be bound to the ToS provided herein.


If you do not agree to all of these terms and do not wish to be bound by them your only recourse is to NOT use, visit, or access any of the services owned by Atlir. Any continued use of our site and services indicates your acceptance in full of these terms.


Changes


Atlir reserves the right to amend or otherwise modify these terms at our sole discretion without notice. Such modification becomes effective at the time of posting.


The clients continued use of Atlir following the modification to these Terms or any other posted policies shall constitute your acceptance of the changed Terms or policies and will signify your continued agreement to be bound by them.


Client Requirements


If the client is under eighteen (18) years of age and over thirteen (13) years of age you must have a legal parent or guardian purchase this service for you. If you are under the age of thirteen (13) or a legal parent or guardian cannot purchase this service for you, then you are not permitted to use our services.


Resale


You may not share, distribute, sell or giveaway our services or products including but not limited to your account, OpenVPN configuration files, our IP’s, or our content.


Privacy


We don't tell anyone anything.


The only information regarding the VPN connections that we may collect is, time of connection, time of disconnection, the VPN you connected to.


This information will be stored on our servers for a maximum of one (1) day. This data is erased daily


Credit card payments and bank deposit leave records. These are kept by the banks and card companies and can't be erased by us. To pay anonymously, use Bitcoin with proper anonymisation.


Support


All services and products we provide come with limited support, we will attempt to help you get started and troubleshoot errors. We reserve the right to deny and support request no matter what the reason may be. We provide email and ticket support. You may contact us via our contact page.


Refunds/Payment Disputes


All sales are final, there will be no refunds given out in anyway. Starting any type of false disputes with our payment processors or otherwise making available funds owed/paid to Atlir will not be tolerated. We reserve the rights to suspend your account without a refund.


Provision of Services


The client acknowledges that Atlir may modify, or discontinue any of our services at any time at our sole discretion with or without notice.


Atlir does not guarantee constant uptime, or access to any of our services. We strive to provide the best services available however from time to time these services may be rendered unavailable due to attacks on our network/services, interruptions of service from our upstream providers, or interruptions of service from our hosting providers. Atlir will attempt to reimburse the end user, non monetarily, for any extend periods (one (1) day or more), by extending the client’s access time (“Subscription”) on our service.


Account/Subscription


We reserve the rights to suspend, or modify the client’s account and/or subscription as we see fit with or without notice. We may also block access to your account permanently. All passwords will be securely stored in our database, in case of a security breach, we are not responsible for any part of your account. You may only have one account registered, failure to comply may result in all accounts being permanently banned. Permission to create additional accounts may be request via support prior to registering. Masking your real IP and disposable emails will not be tolerated, using them may result in a ban. We restrict access to our paid service or products to users who have registered with us and have an active subscription.


Liability


The content and services provided by Atlir are provided without any guarantees, conditions or warranties. To the furthest extent permitted by law Atlir and its affiliates, agents, employees, owners, representatives, licensors, or third party partners shall not be held liable to you or any other person for any direct, indirect, special, punitive, incidental, exemplary or consequential loss or damage incurred by the use of, the inability to use, or the results of use of our services, content, or material provided by Atlir, including, without limitation any liability for:

  • loss of business;

  • loss of income or revenue;

  • loss of profits or contracts;

  • loss of data;

  • loss of goodwill; and

  • for the loss or damage of any kind, tangible or intangible, arising by the use of or inability to use the services or content, deletion or corruption of data, permanent or temporary interruption of service, tort (including negligence), breach of contract, or any other claims for direct financial loss that are not excluded by any of the categories set out above.


Atlir may contain links to, or make use of third party services, these services may have their own Terms of Service and Privacy Policy. We are not liable for the content or actions by these third parties.


Indemnity


By your use of the services and content posted and provided, you hereby agree to indemnify, defend and hold harmless Atlir, its affiliates, agents, employees, owners, representatives, licensors, and third party partners (each an "Indemnitee") from and against all demands, claims, actions, or causes of action, assessments, losses, taxes, damages, liabilities, costs or debt, and expenses, including, without limitation, interest, penalties, and reasonable attorneys’ fees and expenses and expenses of investigation (collectively "Damages"), asserted against, assessed upon, resulting to, imposed upon, or incurred by an Indemnitee arising from:

  • your use and access of Atlir and our services;

  • your material breach of this contract;

  • your violation of any third party right including without limitation any copyright, patent, trademark, property or privacy right;

  • your negligence, recklessness, violation of law or wilful misconduct;

  • any content or material you submit or transmit through our services; or

  • any claim that your use cause damage or injury to any third party.


In addition, you hereby agrees to indemnify any Indemnitee for such Damages as described in the previous sentence as they are incurred by the Indemnitee irrespective of any ongoing or continuing legal proceedings and the relative timeframes and issues associated with such proceedings, or the relative success or nonsuccess the Indemnitee may experience in such proceedings.


Acceptance Use Policy


You will be held responsible for your account, and all of the actions committed on by it or whether done by you, the original account holder, or by others, regardless of whether or not the account was compromised. The original account holder shall be held responsible for all fees, ToS and AUP violations.


By using our products or services you must agree that:

  • you will provide accurate data upon registration;

  • you will comply with all applicable laws in the country you are located as well as U.S. law; and

  • you will ensure that your account is secure and in good standing.


Prohibited Uses

You may only use our products and services for lawful purposes. You may not use our products or services:

  • in a way that breaks any applicable law or regulation in the country you are located as well as U.S. law;

  • for harming, threatening, or stalking another individual or corporation;

  • for email or bulk messaging spam;

  • for DoS or DDoS attacks;

  • for vulnerability scanning, or host enumeration;

  • for the viewing or distribution of child pornography;

  • for illicit behavior or activity; or

  • for sending, “spreading”, or otherwise making available viruses or malware.
